By using this website, you certify that you have read and reviewed this Agreement and that you agree to comply with its terms. If you do not want to be bound by the terms of this Agreement, you are advised to stop using the website accordingly.Toucan Birding Guides only grants use and access of this website, its products, and its services to those who have accepted its terms.

Intellectual property
You agree that all materials, products, and services provided on this website are the property of Toucan Birding Guides, its affiliates, directors, officers, employees, agents, suppliers, or licensors including all copyrights, trade secrets, trademarks, patents, and other intellectual property. You also agree that you will not reproduce or redistribute the Toucan Birding Guides’s intellectual property in any way, including electronic, digital, or new trademark registrations.
You grant Toucan Birding Guides a royalty-free and non-exclusive license to display, use, copy, transmit, and broadcast the content you upload and publish. For issues regarding intellectual property claims, you should contact the company in order to come to an agreement.
In cases where client photos or other visual media are used on the TBG website, permission to use the material will be sought beforehand, and written credit will be accorded to the author on the website.
User accounts
As a user of this website, you may be asked to register with us and provide private information. You are responsible for ensuring the accuracy of this information, and you are responsible for maintaining the safety and security of your identifying information. You are also responsible for all activities that occur under your account or password.
If you think there are any possible issues regarding the security of your account on the website, inform us immediately so we may address them accordingly.
We reserve all rights to terminate accounts, edit or remove content and cancel orders at our sole discretion.
Applicable law
By using this website, you agree that the laws of Argentina, without regard to principles of conflict laws, will govern these terms and conditions, or any dispute of any sort that might come between Toucan Birding Guides and you, or its business partners and associates.
Disputes
Any dispute related in any way to your use of this website or to products you purchase from us shall be arbitrated by state or federal court in Posadas, Misiones, Argentina, and you consent to exclusive jurisdiction and venue of such courts.
Indemnification
You agree to indemnify Toucan Birding Guides and its affiliates and hold Toucan Birding Guides harmless against legal claims and demands that may arise from your use or misuse of our services. We reserve the right to select our own legal counsel.
Limitation on liability
Toucan Birding Guides is not liable for any damages that may occur to you as a result of your misuse of our website.
Toucan Birding Guides reserves the right to edit, modify, and change this Agreement at any time. We shall let our users know of these changes through electronic mail. This Agreement is an understanding between Toucan Birding Guides and the user, and this supersedes and replaces all prior agreements regarding the use of this website.
Payments
| The client will arrange and effect payment of a minimum of 50% total TOUR PRICE by online wallet or bank transfer at least ONE WEEK before scheduled start date of tour. Note: this requirement may be waived if payment is agreed to be made in cash. |
Cancellation
| In the event of cancellation by either party more than 48 hours before scheduled START TIME of tour, Toucan Birding Guides will undertake to refund a maximum of 50% of total TOUR PRICE. In the event of cancellation less than 48 hours before the tour is due to start, no refund of any advance payment will be made. |
Client No Show Policy
| A No Show will be declared.if the CLIENT fails to be present at the MEETING POINT previously agreed in the ITINERARY, A No Show is treated as cancellation less than 48 hours before start time and as such, following a No Show, no refund will be made. The Toucan Birding Guide representative will wait 1 (one) hour after the agreed START TIME before declaring a No Show, and after making every reasonable attempt to re-establish contact with the CLIENT and initiate the TOUR, after which time Toucan Birding Guides will end services and any outstanding contractual agreements stated in the ITINERARY or in other communications between the CLIENT and Toucan Birding Guides will terminate. |
Correspondence with Toucan Birding Guides
After initial contact has been made, and following discussion of the client’s interests and requirements, an ITINERARY will be issued. Once confirmed, the ITINERARY will contain the following specific information:
ITINERARY – structure and content
START TIME – The time and date that services with Toucan Birding Guides take effect
MEETING POINT – The place we will meet up.
BIRDING LOCALITIES and OVERNIGHTS – The places we will visit, when and where we eat and stay overnight, if applicable.
TOUR PRICE – the total price of the services offered in the ITINERARY. Note – TOUR PRICE is always quoted as total price, not per person, unless specifically requested by the client
OTHER INFORMATION such as what is included, and not included in the TOUR PRICE, what the guide will take with them and any other information pertinent to your specific trip will also be included in the ITINERARY
